Career Clutch is committed to protecting student data and using it only to support educational services authorized by schools and districts.
We do not sell student data and do not use student information for advertising or commercial purposes.
How Career Clutch supports the NY Parent Bill of Rights
1. Student data is used only for educational purposes
Career Clutch uses protected data solely to:
- Provide interview practice tools
- Support career readiness development
- Generate educational feedback
- Support educator insights
- Maintain platform security
We do not use student data for marketing or commercial purposes.
2. Student data will not be sold
Career Clutch does not:
- Sell student personal information
- Rent student information
- Share data for advertising
- Build commercial profiles of students
Career Clutch generates revenue from providing educational software to schools, not from student data.
3. Confidentiality protections are in place
Career Clutch maintains safeguards designed to protect protected data, including:
- Encryption in transit
- Encryption at rest
- Role-based access controls
- Secure cloud hosting
- Incident response procedures
Access to student data is limited to authorized personnel with a legitimate operational need.
4. Parents have rights to inspect and review student data
Under FERPA and NY law:
Parents and eligible students may:
- Inspect student records
- Request corrections
- Request deletion where applicable
- Requests should be directed through the school or district.
Career Clutch supports schools in fulfilling these rights.
5. Data is retained only as necessary
Career Clutch retains protected data only as long as required to provide services.
Upon contract termination:
- Data is deleted or returned according to district direction
- Systems are updated within reasonable timeframes
- Backups are purged according to retention schedules
6. Vendors must maintain data security safeguards
Career Clutch maintains administrative, technical, and organizational safeguards aligned with:
- NY Education Law 2-d
- NYSED Part 121
- FERPA
- COPPA
- SOC 2 security principles (aligned)
7. Breach notification obligations
If a confirmed breach involving protected data occurs:
Career Clutch will:
- Notify the school or district without unreasonable delay
- Provide details of the incident
- Support required notifications
- Implement corrective measures
8. Third-party vendors must protect data
Career Clutch may use trusted service providers only to operate the platform.
These providers:
- Are contractually bound by confidentiality
- May only use data to support Career Clutch services
- Cannot sell or independently use student data
- Must maintain security safeguards
Career Clutch remains responsible for vendor compliance.
9. Transparency about data practices
Career Clutch provides transparency through:
- Privacy Policy
- Data Security Policy
- Sub-Processor List
- Vendor Security Responses
- Trust & Compliance documentation
These materials are available to districts upon request.
10. AI transparency (emerging NY expectation)
Career Clutch uses AI only to support educational functionality such as interview practice and feedback.
AI does not:
- Replace educators
- Make employment decisions
- Provide therapy
- Create commercial datasets from student data
AI outputs are educational tools requiring human oversight.
